Globe and Mail - Feb 15, 1980, Friday - pg.# P.4 - By David Logan 'Bird lady' weighs appeal of ruling against land claim The bird lady of Mississauga has lost her latest attempt to buy two acres adjoining her sanctuary. Bernice Inman Emery said in an interview that she has not yet decided whether to appeal a County Court decision rejecting her claim that she has an option on the land at $5,000 an acre. It is very upsetting. But I'll fight for the (sanctuary), not for myself. She was given the single acre she lives on with her husband Jack by Roy Ivor, who cared for thousands of injured birds. Mr. Ivor died in December at 99. Her option - to be exercised on Mr. Ivor's death - was part of a purchase agreement for her present land, she said. Judge Chester Meisner ruled recently that the option is not valid because Mr. Ivor revoked it in 1975. Land valued at $75,000 an acre The two acres, adjacent to built-up areas, have skyrocketed in value since the original agreement in 1970. They are conservatively appraised at $75,000 an acre - assuming single-family development. In the mid-1970s, the late naturalist's lawyers moved to clarify the title to the property. One result was that Mr. Ivor's estate owns the two acres. But his will has not been probated and its terms have not been made public. Meanwhile, some naturalists allege that the bird sanctuary is in poor condition, in part because Mrs. Emery has been ill. Michael Singleton of the Federation of Ontario Naturalists said in a telephone interview that Mrs. Emery has been cautioned several times about provisions in the Ontario Game and Fish Act and the federal Migratory Birds Convention Act. She had a bald eagle for three years which was housed in a rotting, 8-by-10 cage divided in half by chicken wire. Those are not acceptable conditions. 'Birds must be caged properly' He added that Mrs. Emery has seen fit to ignore the warnings on the numerous requirements of such a sanctuary. I'm not trying to suggest that her work is worthless nor that she isn't sincere, but some of these birds should be properly caged or they should be destroyed. Mrs. Emery wouldn't respond to the claims about her care of the birds. However, she said earlier that Mr. Singleton has never been to her bird sanctuary and gets his information from somebody else. She wouldn't say whom. Mr. Singleton's attitude toward injured wildlife, she
