Couple operating cat shelter ignore Mississauga eviction order

 A couple who are being evicted from the city-owned home where they operate a cat shelter have ignored a deadline by Mississauga council to get off the property.

 Lois and Brian Stevens were supposed to be out on Tuesday, along with their 40 cats, but say they'll dig in their heels and fight the city in court.

 They've hired a lawyer who specializes in the Landlord and Tenant Act., to handle their case, Lois Stevens says.

 "We're going to argue that the contract (lease) we have with the city, although legal, is not enforceable on the grounds they are citing," she says.

 Those grounds include concerns over the safety of the home.  The city argues that the 75-year-old dwelling needs $8,000 in repairs to bring it up to building code standards, and that an adjacent slope is unstable.

The Stevens are violating their lease and the animal control bylaw (no more than four cats to a home) by operating the shelter, city officials say.

 Mississauga plans to demolish the house to make way for the future development of a botanical garden on the site, overlooking the Credit River at Burnhamthorpe Rd. W.

 The Stevens made a last ditch appeal to city council last week to let them stay until the city needs the property which won't be for another three years but were turned down in a 7-2 vote, with David Culham and Ted Southorn supporting their request.

 Culham says he was "strongly against," the decision but must abide by it and will stay out of any further dispute between the city and Stevens.

 "But I think the whole exercise (by the city) has been a total waste of time," he says.

 "There has been a lot of misinformation and political wheeling and dealing over something that never should have occurred."
