Cat shelter couple may get reprieve

A proposed legal settlement between the City of Mississauga and its best-known tenants, Brian and Lois Stevens, would allow the couple to remain in their home along the Credit River until June 1, 1991.

Lawyers for the city and the Stevenses have reached an agreement that would allow the couple to remain on the Bird property on Burnhamthorpe Rd. W. until the middle of next year.

City solicitor Bruce Thom confirmed Monday that minutes of settlement between the Stevenses' lawyer and the solicitor representing the city, from Toronto law firm McCarthy and McCarthy, have been agreed on.  However, Thom said he has not yet discussed the proposal with city councillors who must approve it.

City council voted to evict the couple last summer after rejecting their arguments that the should be allowed to stay for an additional two years until Brian Stevens retired.

The home has been used for several years as the site of the Burnhamthorpe Cat Shelter and animal lovers rallied to the support of the Stevenses, urging council to allow them to stay.  The majority of council felt that the couple had violated their lease agreement, as well as the city's animal control bylaw, and ordered them out by Oct. 31.  The Stevenses refused to leave and the city instituted court action under the Ontario Landlord and Tenant Act.  The issue was to go to court this week when the settlement was reached.

The proposed agreement makes no provision of legal costs.

Lois Stevens has been trying to wind down the operation of the cat shelter, which has been routinely praised by animal welfare officials for its cleanliness and its "no kill" policy.

City council will deal with the proposed settlement next Monday.
